Excerpt from April 22, 1999 memorandum of John
Gleason: |
"... you state that these individuals made numerous
extrajudicial public statements and disclosures to
the author of the above mentioned book ("'Perfect
Murder Perfect Town" authored by Lawrence Schiller
and released in 1999) and to tabloid reporters,
which discussed the character, credibility and
reputation of the Ramseys ; which expressed opinions
regarding the culpability of John and Patsy Ramsey;
which disclosed evidentiary obstacles; and which
expressed negative opinions regarding the Boulder
Police Department's work on such case. Please
realize, however, that the district attorney is
elected by the people and has considerable
discretion in the investigation and prosecution of
particular matters. As the district attorney makes
the decision whether or not an individual will be
prosecuted for a particular crime, the district
attorney may also discuss the relevant
considerations which go into that determination.
These considerations could include the character and
credibility of witnesses and evidentiary issues.
While you may find such statements distasteful,
unfortunate, and ill-advised, this office does not
believe that such statements rise to the level of a
violation of the Colorado Rules of Professional
Conduct."
